NEW YORK (Dow Jones)--Net2Phone, an Internet phone service provider owned by IDT Corp. (IDTC), filed a lawsuit against eBay (EBAY) and Skype alleging the companies infringed on its "point to point internet protocol" patent.

The lawsuit, which was filed late Thursday in the U.S. District Court in Newark, N.J., seeks an injunction blocking continued infringement as well as damages.

"Net2Phone will continue to suffer irreparable harm" if the companies keep infringing on the patent, the company said in court papers.

EBay bought Skype for $2.6 billion in cash and stock last year. Skype allows its users to talk to one another over personal computers for free. The company also allows cut-rate, pre-paid voice calls to be made from PCs to regular telephones or cellphones. Skype boasts about 100 million users.

Gil Nielsen, an IDT spokesman, said the company doesn't comment on pending litigation. An eBay spokesperson could not be immediately reached.

Net2Phone, based in Newark, N.J., provides Internet phone technology to cable companies such as Bresnan Communications, Liberty Cablevision in Puerto Rico, Northland Communications and Rural West. IDT bought the remaining 13.8% stake in Net2Phone that it didn't already own in February for $28.1 million in cash, or $2.05 a share.
