As was stated, Prop 13 changed the CA constitution. A state judge, including the CA Supreme Court, is bound by it and HAS to uphold it. It is possible FEDERAL court could rule that it violated the federal Constitution and strike it down that way. A CA Supreme Court judge who refused could be impeached by the legislature or lose his next confirmation election for this. In this state, state Supreme Court justices, including the Chief Justice, have to be reconfirmed by state voters every 6 years. Rose Bird, who refused to uphold any death penalty, lost a confirmation election and was replaced.

Many have tried, but none have succeeded, in killing it. It is the "third rail" in CA politics: threaten it and your political career is over.
