The entire Stalin Terror, with it's mountain of bodies, was based on two lines in the Soviet "constitution".

That is entirely irrelevant. It wasn't following the constitution that was wrong it was starving, torturing, enslaving, imprisoning, killing etc. millions of innocent people, and oppressing those that you don't arrest or kill. No one is proposing anything that vaguely resembles such a course of action, and the implication that they are is disgusting.

Stalins oppression was about getting what Stalin wanted at whatever cost to anyone else. It wasn't about enforcing immigration laws, nor was it about those two lines in the constitution. If the constitution didn't enable the oppression it would have been modified or ignored at the whim of Stalin.
