Yep. Which is disingenuous but gets him where he wants to go. The more I read on this case and the more I type SI responses, the more I'm convinced that the Hudson case lays a very critical precedent. Breyer sees that, so I assume the other three dissenting justices did. This now strikes me as one of the prices, unanticipated as best I can tell, of the shift from O'Connor to whatshisname (blocking big time, as they say).
