The First Amendment? You Funny Man, You!

The First Amendment limits government activity, not private activity. Blocking speech or VoIP is perfectly legal for an ISP to do. There are no rules against it. That is why the network neutrality issue came up -- the telcos are redefining themselves as ISPs, so they will be allowed to do what they are not allowed to do in their role as telcos.

Right now Verizon and AT&T/SBC are under a merger commitment to preserve some degree of neutrality (the Powell Principles) until the beginning of the 2008 presidential campaign. So they can bleat that they have not done anything wrong, and don't plan to do so in the near term. But they are certainly studying options, and the equipment vendors are pushing very hard with Deep Packet Inspection boxes. Several new ones were shown off at Globalcomm a couple of weeks ago.
