Generic doxepin is available only as capsules or liquid. Patients may willingly snap a tablet in half, but measuring out half the contents of a capsule… is far less likely IMHO.

I used to split 20mg Prozac capsules to save money because I was self-pay and the 10mg capsules cost almost the same amount as the 20mg ones.

Perhaps this is a bad example because the half-life of Prozac is so long it didn’t make much difference if the split was imprecise. But my main point is that splitting capsules isn’t all that cumbersome if the economic incentive is there.

If a generic company decides to start manufacturing a tablet, Somaxon will take that as indicating an intent to make a 'splittable' formulation as a means of poaching...and intends to sue them.

This would make an interesting lawsuit to follow and handicap. Can you recall a similar case being litigated?
