Justices Antonin Scalia, Clarence Thomas and Samuel Alito Jr. dissented.

The usual suspects. Even if the other neocon had voted with them, it would still be 5-4. No wonder the snakewoman wants to poison Justice Kennedy...

Thomas took the unusual step of reading his dissent from the bench, the first time he has done so in his 15 years on the court. He said that the ruling would "sorely hamper the president's ability to confront and defeat a new and deadly enemy."

If Thomas was not in the SC, he would have done very well on Faux News or on R2F2 radio, a la Hail Hannity or Rush Viagraugh! ;-)
