VERY BAD NEWS

Not really, overall. The majority ruled the commissions "illegal" because Congress did not say the properly explicit magic words to 1. allow the President to form the tribunals, and 2. to allow the deviation from "uniformity" with the normal courts-martial procedures. I expect Congress probably will now do so.

The majority also really got on the government for charging Hamdan with conspiracy and not some charge recognized in federal or international law of war. I think that might be right. Get to it, Congress.
