Yes, exclusive to the executive branch under the powers to wage war and execute foreign policy. Under established common law, there is no judicial power over these types of cases. The Supremes made it up of whole cloth yesterday, but that is of course something they can do with relative impunity. Please note that while this seems extreme, it relates only to foreign aliens captured as combatants and held on foreign soil.
