Before yesterday, different procedures would apply, ones which would involve some level of judicial scrutiny. Exactly what these procedures would be, I don't know.

The reason behind holding the detainees in Guantanamo was to keep them off US soil and therefore take advantage of decisions like the one I mentioned. Doing so would give the detainees no access to the federal courts except as mandated by Congress.
