Personally speaking, and off the top of my head, as illegal combatants, these detainees should qualify to be tried by military tribunal as "spies and saboteurs".

Why do you accept the designation of them as "illegal combatants"? As far as I know they were captured when the US invaded a country where they were living, and they (I guess) somehow resisted the invasion. I have no information about how they resisted, or whether they even did resist the invasion, because as far as I know the US has never listed the criterion which determined which members of the local population went to Gitmo, which went to Afghan prisons, and which were just let go.

Isn't one of the guys in question a Yememni that is allegedly Osams's driver? If he never wore a military uniform because he's a driver, why does he get stuck in this nebulous limbo of "illegal combatant" land?
