But after the papers were published, no newspapers were prosecuted. Which suggests to me that the Justice department didn't think the law was actually broken by the NYTimes.

You know as well as I that there are numerous factors that go into the decision whether to prosecute. The fact that the NYT was not prosecuted for publishing the Pentagon Papers is by no means precedent for a decision on prosecution in the current case.

That said, I don't think there will be a prosecution of the Times.

DOJ, however, should search out and charge those who leaked the classified information in the first case.
