excerpts...
CDEX has not infringed and does not infringe any claim of the '369 Patent, either literally or under the doctrine of equivalents, nor has it contributed to infringement by others, nor induced others to infringe.
The '369 patent is invalid and void for failing to meet the conditions for patentabiltity...
The '369 patent is unenforceable as a result of inequitable conduct arising from Plaintiff's and/or Plaintiff's counsel's intential failure to disclose relevant prior art that was material to the patentability of the claims of the '369 patent.
Nevertheless, upon information and belief, Plaintiff intentially failed to disclose such material prior art to the U.S. Patent and Trademark Office ("USPTO"), thereby committing fraud on the USPTO.

In 2006 we were named to the publication's "Distinguished Dozen," and in 2004 were ranked among the top 15 departments in the country.
As highly skilled trial and appellate attorneys, we regularly try-and win-the most sophisticated and complex business cases. Our members include former U.S. attorneys and assistant U.S. attorneys, fellows of the American College of Trial Lawyers, former law clerks of the U.S. Supreme Court, courts of appeal, federal district courts and state courts, and numerous others who have achieved professional distinction in all areas of law and business. Our clients' business goals are paramount. We consider all the options, first evaluating whether litigation can be avoided through alternative measures, and, if not, determining how to handle the resolution of business disputes in the most effective manner. We are backed by an international array of capabilities and resources. With over 1,000 attorneys in offices in the United States, Europe, Latin America, and Asia, we have the ability to represent clients across borders, industries, and practice areas.
