If you have the right to put a 500lb bomb on someones head I think you have the right to gather intel on them. I'm generally against overly broad readings of powers but generally authorization to use military force would seem to include all sorts of surveillance and monitoring of the enemy. Of course the monitoring goes beyond the enemy, even if its targeted at the enemy so there is some reason to support attempts to limit it. OTOH I don't see how the monitoring amounts to "a blank check to disregard the Constitution as he deems fit", and your response seems to be that it is more a violation of a law rather than a violation of the constitution. Not that possibly illegal activity by the president is at all a good thing, but if it only violates FISA it isn't unconstitutional.

Do you think the detainment's at Gitmo violate the law and or the constitution?
