Yes. And the Nixon Administration didn't want the Pentagon Papers released. The point is that it is utter nonsense to claim that the Times was revealing the existence of something or, since you love to make legalistic distinctions, the details of something, when the financial surveillance program (including SWIFT)was widely known prior to publication. It was known to UN officials who included discussion of new US surveillance efforts in a 2002 report. It was well known to security consultants around the world. It was alluded to by Treasury officials in congressional hearings. And, here is where the rubber meets the road, it was known to terrorist groups who quit using financial institutions years ago because of surveillance. The only people in the dark, you'll notice, are the American people -- who pay for the program -- and most of their elected representatives who in brighter days performed a quaint function known as oversight.
