1) how did qcom gain these patents (via acquisision?).
2) why were these not declared as part of the regular standards setting process.
3) what reaction might GSM/WCDMA operators have here.
4) are Qcom prepared to license these patents (if valid) on FRAND terms?
5) how might they be valued, if Nokia is found to be infringing? If its only a few patents, could be insignificant.
6) How long might this process take to decide on, considering the layering in of appeals?


1) Qualcomm developed them for use of data on CDMA systems. When talking with Nokia about how to improve WCDMA Nokia learned about them and figured out that they could improve data rates on GPRS and EDGE with these. Nokia then put them into revisions of GPRS and EDGE standards (I think) - Nokia might just be using them for its systems. Qualcomm didn't complain as long as Nokia and WCDMA was on track. Once Nokia supported the anti-trust case with Broadcom and others, Qualcomm decided not to be so accomodating.
2) I think they were included in the standard but could be wrong here.
3) GSM/WCDMA operators would be annoyed at Nokia for upsetting the apple cart.
4) Qualcomm was willing to offer them for free along with the licenses on terms that all had agreed to for its WCDMA licenses. Once parties back off for these, the GPRS/EDGE licenses would be part of the total negotiating situation.
5) "If it is only a few patents" - You continue to buy into the idea that it is the number of patents that matters. Qualcomm takes the analogy that there are many patents involved in an airplane, some are for the wing, engines etc that are critical for flight. Others might be for seats and ashtrays. The former are more important.
6) "How long..." Depends on if settlement occurs or not.
