'Essential' Patents

BDAZ,

<< It is more than obvious that the QCOM WCDMA IPR is the "most" essential to the technology >>

In the world of open and collaboratively developed technology standards in SDOs/SSOs governed by FRAND (however weakly defined FRAND currently is and acknowledging that to be "essential" essentiality must be certified not just declared) a patent is either essential or it is not essential. The concept of 'more essential' or "most" essential does not exist.

<< It is more than obvious that the QCOM WCDMA IPR is the "most" essential to the technology simply because it is present in the standard. >>

Being present in the standard does nothing for nobody. Some 40 companies have declared patents 'essential' to the 3GPP UMTS (WCDMA) technology standard.
