The enforcement comes from compliance; there will be no military tribunals until Congress sets up a legal framework to hold them.

Fortunately, Supreme Court rulings rarely have to be enforced against a noncompliant party to a case. If we get to the point where Bush ignores the SCOTUS like he blows off Congress, then we are in trouble.

I don't think he has the cojones to go that far. But I wouldn't rule it out 100% if he goes off the deep end sometime before January 2009.
