Thanks for the link, Blue, but I can't read it. I'm not signed up with the NYT.

I don't know the circumstances in this case, but there are many times when the notice to appear is presented after the hearing date, so the person who didn't get timely notification loses by default. So, maybe he's to blame, I don't know.
