A headache is putting it mildly....

This court ruling is extremely important for Cadence. In Judge Whyte's initial ruling, he stopped short of shutting down Avant's business because he was concerned about hurting innocent employees. The appeals court basically struck this down and held that the copyright laws must take precedence.

I am not surprised by this reversal. The evidence in this case is beyond overwhelming. Even though some Avant employees - through no fault of their own - will surely face some economic harm, the economic harm that the plaintiff suffered must be considered above all. There is simply no way to ignore that Avant STOLE Cadence property.

It is amusing to watch Avant try to keep putting out these little fires. They issued a press release right after this ruling stating that it didn't matter because they can keep selling their Aquarius line. What they neglect to mention is that the judge also recommended that the lower court consider prohibiting Avant from selling Aquarius.

Avant's legal expenses are mounting, their customers are balking at placing new orders due to ethical concerns, and there is an extremely strong possibil;ity that several officers and directors of the company will face prison sentences and stiff fines. Just when they think everyone has forgotten about their legal problems and the stock is riding high...another fire springs right up. Avant shareholders must be downing a lot of dramamine to ride this roller-coaster. In the meantime, Cadence shareholders are watching their stock climb ever-higher.

The crooks and liars at Avant have made numerous claims that they are gaining market share. This is a crock. Cadence continues to kick Avant's crooked butt across all product categories. In the meantime, Avant concentrates on making dubious acquisitions that line the pockets of Gerald Hsu's cronies at the expense of the shareholders. Avant also seems to invest a hell of a lot of time issuing shrill and misleading press releases.

I think Avant's future is sealed. Avant shareholders would be well advised to sell while there is still a bid out there and consider buying a legitimate company like Cadence, or at least putting their money in a nice, safe mattress.
