No, it was a rhetorical question.

I think the administration could make a reasonably decent argument that captives from active military zones like Iraq and Afghanistan are POWs but my understanding is that some of the men in detention were seized in other places.

So, unless the SCOTUS agrees with the administration's metaphysical argument that the WOT is an actual war, not a metaphorical war, classifying the ones seized outside a war zone as POWs won't fly.

'Tis a predicament for the administration. But maybe Stevens will pop off soon and make it easier on them.
