I wouldn't be so sure. Since FDR, its been the norm for presidents to go to war without the authority of Congress. Everyone knows that the Constitution doesn't give presidents that authority but they get around it by asking Congress to approve the war expenditures. That doesn't change the fact that they are in violation of an important check of the checks and balances system. To my knowledge no one has contested that particular issue. It will be interesting to see how the courts rule.
