This is the main issue as I see it- framed in the Dale case: "The issue is whether Connecticut can sanction or assist Boy Scouts in the maintenance or the furtherance of its discriminatory policies. " bsalegal.org While the cases involving homosexuals tend to be mixed due to the moral repugnance some of the religious justices feel for homosexuals, I doubt you will find ANY case which was a winner and involved the government supplying facilities to a group that was discriminating on the basis of race.
