Yeah, but there has to be some sort of exponential decay with time. You can't weight the really ancient issues equally with modern ones.

It is an odd problem however. Law does tend to give more weight to prior claims. For example here in the West most water rights are stronger if older. Unless they are the oldest ones with Indians. So from this I gather that age strengthens claims up to a point, after which it weakens them. Although it might be racial. I don't know.
