Yes.

That is totally extraneous. The key matter is whether the administration is justified in bypassing the law. For the moment, we will ignore the constitutionality of the act and focus on justifications. The administration has justified their actions on the basis of there not being enough time to go through the process. Which, on the face of it, appears to be a lie, the law does allow for warrants to be obtained up to 72 hours after the fact. So what justification is there for breaking the law? One reason could be that they are aware that the court won't agree with the need of the wiretap. Given that the only time the court has turned down any requests had been from this administration, they might have a point...
