The NASD short sale list is only a month of short sales and does not include "grandfathered" or naked short sales. It also does not include the stock that was naked shorted in 2001 which the lawsuit was filed about. Harvest Court has had five years in which to cover that position after driving the stock price down. Having that list is a good idea and should have been done years ago, but it is not proof of anything that happened that long ago. What the brokers are reporting to the NASD for this list are only the new short sales not the grandfathered naked short sales. That issue is still in the 60 day comment period with the SEC.
