The Nokia/Q battle is turning into a nasty war of attrition.

Filing right before the probably unfavorable ITC decision [not to mention after Sprint's 4G decision], is really dirty pool because I doubt very seriously on first impression that the Delaware Chancery Court has the jurisdiction to order Q to do what Nokia asks it to do. Plus the issue is pending in the EU; the Delaware court is unlikely to want to step on its jurisdictional toes.

My guess is that this suit will be dismissed, but not after a bunch of erroneous headlines hit the share price.

The tea leaf is more like a large plasma screen now: negotiations have probably broken down and it is unlikely that Q and NOK will reach any kind of agreement. The filing of this suit is not only dirty pool, it is a shot across the bow that missed only by a few inches.

Nokia is taking this action as a defensive measure to ensure there is a consolidated forum for addressing these issues and is asking the Court to enforce Qualcomm's obligation to negotiate royalties on FRAND terms.

The height of hypocrisy. If Nokia thought it needed a consolidated forum, it could have filed in Delaware in the first place. If this part of the PR is not complete hogwash, it should have also stated that it is willing to drop the EU claim so that a single case in Delaware can go forward.

What a bunch of asses. I hope Q puts the wood to them.
