Nonsense. If the circumstances are that there isn't sufficient evidence to justify a prosecution than a criminal shouldn't be prosecuted.

And many criminals effectively can't be prosecuted. You could have tried to prosecute Stalin, or Hitler or the leadership of the Japanese military in 1937 for their crimes, but you could only do so in absentia and the prosecution would have been a joke. Try prosecuting those who lead the crackdown in Tienanmen square, or you could prosecute the Iranian or North Korean leadership...

Our own President should be prosecuted for authorizing widespread illegal wiretapping.

No, because its not clearly illegal, but rather a situation where there is a legitimate debate about the powers the constitution authorizes to each branch of the government. This is one of those borderline cases. If in the end their is consensus that the president doesn't have this power it shouldn't normally result in prosecution. Even impeachment wouldn't be called for.

Your attempt to portray war crimes as limited to those who are defeated in conventional war is absurd.

Your attempt to portray what I said as "war crimes are limited to those who are defeated in a conventional war", is absurd. War crimes are war crimes for the winner as well, or in inconclusive wars. But only those who are defeated are normally subject to international tribunals. There is no world government that can impose its ideas on undefeated powers.
