Spying within the US, using wiretapping of citizens requires a warrant which is what this entire discussion is about. Please stay on subject.

What passage in the Constitution allows for the Presidential powers you speak of? What power is FISA denying the President?

So now you're going to define 'war' as a shooting war? Then the Cold War wasn't a war and the war against terrorism, when there is no American shooting at a terrorist isn't a war. Let me get these definitions straight. War is whatever you want it to be whenever you want it to be under conditions you set.

I thought War was declared by Congress.

When did Congress declare war on Islamofascism. Please define Islamo, fascism and Islamofascism....in any order you prefer.

Bush's argument about wiretapping without warrants is clearly nonsense. If he could do so, if anyone could do so then why bother with warrants at all? Why would any president or government official bother with FISA in the first place?
