As a legal issue--as I am sure as member of Bar you are aware--the states are left to regulate marriage as an institution. They therefore can legally define what marriage entails--as long as it is consistent with the state constitution (or they can amend the state constitution if the legislature's definition is out of whack with the state constitution--like the MA. legislature is considering doing).

This definition will determine what class of people can marry. (Some people now have marriage ceremonies with their pets.) It is not some fundamental right protected by the US Constitution. Therefore, individuals rights to choose their partner can be limited by State Law--which in the end will be determined by the State's politics.
