I wasn't clear in my statements. I meant to question whether Qualcomm included CDMA as part of the claims, thereby restricting the patent to just CDMA.

A patent is a balancing effort between the patentee's desire to be as a broad as possible and the patent office's requirement that the claims cover only what is novel. What I was pointing out was that if Qualcomm's patent claims were not restricted to CDMA systems then they taught how to improve all RF systems. Including GSM/GPRS/EDGE. So, taking a quick look at 6496543, I see nothing that restricts the claims to CDMA, rather it claims to cover cellular systems. (I am not a patent attorney)

The next question is whether Qualcomm licensed the use of these patents to improve the performance of GSM systems. I sure hope not.
