As a layman I could be wrong, but I would assume that extensive federal legislation to protect a minority like the disabled is underpinned by the equal protection clause, and upheld in court challenges because of that clause.

Kind of a chicken and egg thing, right?

Over time, the social consensus to keep dumping on one group or another fades, and they come under the umbrella of equal protection. It will be the same for homosexuals in a matter of decades if not sooner. Everything in between is just a temporary food fight, IMHO.
