I'm surprised Apple settled the lawsuit, but the cost of uncertainty for the next few years, even if they wind up winning the lawsuits is worth eliminating for about $1/iPod. The cash means much more to Creative today than any potential gain from questionable patents. As the lawsuit drags on, the legal costs for both companies would be higher than the settlement costs. Overall a win/win for both companies. In the long run, Creative still has to worry about their role in the MP3 market that they held such an early patent and help create. Maybe they should give up the fight there and focus on their other products which they have a better competitive position.
