Only if QCOM was actively participating in the applicable standards setting process, which as I understand it, was a process for setting / evolving the GSM standard. As such, it is also my understanding that Qualcomm was not involved and therefore has no obligation to license its IPR. From what I have read, this appears to be the heart of the issue
