Immunity in a situation like Iraq is quite common and unexceptional. And it is in effect a treaty with Iraq, it doesn't give us "permanent rights of conquest". No nation would allow that unless it was thrust upon them at gunpoint. Quite a few nations have agreed to it. The US will often waive the protection when the host country has a strong tradition of fair trials. If Iraq had such a tradition I might suggest we waive it for the rape/murder case.
