Qualcomm`s 7/11/05 lawsuit against Broadcom was another action to enforce IPR essential to GSM/GPRS/EDGE standards. In commenting on their filing similar litigation against Nokia, Qualcomm asserted it would not "at that time" file against TI, NEC, Ericsson, Matsushita, or others, though making it clear that future cases could be brought.It is apparent that Qualcomm regard Broadcom and Nokia to be their chief antagonists, provacateurs, and instigators, so focusing resources on them is understandable. If you take the head, the body will follow. As for Nokia`s claims of equitable estoppel (estoppel in pais), "unclean hands" and all other equitable defenses are theoretically available.
