Wrong standard of proof? "Fraud typically has to be proven by clear and convincing evidence, a legal standard which is a close relative of the "beyond a reasonable doubt" standard used in criminal law." Unless you're talking about some strange federal standard, the burden of proof is generally "preponderance of the evidence." "Clear and convincing" standard is not that close to "beyond a reasonable doubt"; it's in the middle.

Just posting so folks not mislead, because I am not sure you're right.
