Fraud and a few other things are judged more strictly using the "clear and convincing evidence" standard, a standard which is difficult to articulate but IMO opinion is closer to the very strict "beyond a reasonable doubt" standard used to convict in criminal cases than to the "preponderance of the evidence" standard.

I usually rate "clear & convincing" above 2/3rds or 63%, & "beyond reasonable" @ least 95%. My rationale is if you have 12 jurors in a criminal trial, & you represent the prosecution, during voir dire, you wanna avoid the 5 out of 100 that you think will have "reasonable doubt" in your case. Whether you win is really luck of the draw . . . but your best with consultants & voir dire to improve your odds.
