Even if they can't pull it off, and they figure they can't pull it off, and even if the network figures they likely can't pull it off, the tiniest chance that it could happen (say 1 in 1000) would still have an effect of chilling speech, as might even the thought that the network would have to go through a long expensive legal battle to fight off the attempt. Even if your sure of wining such battles aren't fun or cheap.
