Agilent is represented by Paul Hastings in a multi-million dollar civil lawsuit that challenges the company's wild assertion that is an ISP entitled to federal immunity in criminal matters.

For one year, Agilent allowed Dr. Cameron Alden Moore, the notorious Crack Smoking Jesus to use the company's intranet to terrorize and e-mail death threats from Agilent in Colorado to families in California.

The FBI investigated and on 14 February 2003, Moore was arrested and charged with a felony. A few months later Agilent fired its in-house terrorist. Moore pled guilty and was convicted in the U.S. District Court for the Northern District of California.

The families filed a complaint against Agilent and Moore in the California Superior Court, Santa Clara County seeking damages for pain and suffering. Moore lost at trial and on 18 April 2005, two of his victims were awarded $1,100,103.94 for intentional infliction of severe emotional distress.

Agilent won summary judgment arguing it was entitled to absolute immunity under the CDA even though it knew and monitored Moore's criminal wrongdoing. The trial court reluctantly agreed and of course the lower-court ruling was appealed.

After Moore's federal conviction, Agilent continued to work with Moore harming Appellants. On 8 June 2006, Moore was arrested for assault, the second time he was charged with a felony in this case.
