Libel and slander don't apply to 'opinion' otherwise folks would be unable to safely express any thoughts about others. Gossip would be extinct :)
Where this situation gets tricky is ABC claims the movie was a 'drama' thereby claiming fiction status. This was a weasel way of trying to avoid litigation. I'll bet in some meeting with attorneys , some honcho asked "how can we get this thing on the air and not get sued?"
I am not familar with the caselaw that covers 'non-news' areas like dramas and fiction. Seems like if the person slandered is readily identifiable, and their reputation is damaged, there could be grounds. We may indeed plow some new legal ground as a result of this, but I doubt it. I didn't see the show, so can't say whether they really did clearly libel anybody. A lot of the 'facts' in our recent history are heavily disputed, anyway.
