Yes patents are allowed that don't meet the legal criteria. This is hardly limited to agricultural patents, but occurs in a variety of different industries. Its not really an issue of GMO crops or agribusiness being a problem. Its a problem with the patent office, and to an extent a tort law problem. Tort reform and patent reform would deal with the issue (and many others at the same time) far better than attacks on GM crops or Monsanto.
