The administration isn't proposing to redefine common article three. The supreme court did. Article three applies "In the case of armed conflict not of an international character occurring in the territory of one of the High Contracting Parties"

Now a very good argument can be made that we should follow it even when there is no clear obligation to do so. It could be considered a moral standard that we should live up to, but even if you accept that argument the administrations position is hardly a redefinition (although if you accept that argument the administrations position is probably something you find morally appalling)
