The president deciding to follow the legal requirements of the constitution doesn't require him to have the judicial branches authority to finally settle constitutional issues.

The constitution gives powers to the president and to the legislature. If the legislature acts outside of its limits the law it makes is invalid. Its invalid immediately before any constitutional review by the judiciary. If the law is an attempt to impose an unconstitutional requirement the president is justified, even required by his oath of office, to not enforce the law. When controversy arises as to an important case the judiciary finally decides the case.
