He doesn't need any authority to decide constitutionality in order to follow the constitution, just as when there is no constitutional issues he doesn't the powers granted to the judicial branch in order to interpret and follow statute law. In either case he can be overruled by the courts.

Nonsense. Only a judge can interpret a law in order to determine constitutionality.
