I don't think secret evidence should be used at criminal trials.

But I don't think captured enemy combatants should have criminal trials.

I don't have a problem with keeping evidence that shows them as enemy combatants secret if its necessary to keep it secret in order not to put US military or intelligence assets in danger. The alternates in that situation are

1 - Don't capture anyone just shoot them.

2 - Capture them but don't bother with any review of their status or require any evidence. If you have any suspicion just lock them up indefinitely.

3 - Put US assets at risk.

4 - Let them go even though we know, or at least have very strong reason to think, that they are enemy combatants.
