1 - Don't capture anyone just shoot them.

Won't work for people that we got, not on the battlefield, but through informers. Anyway, we don't want them dead, we want them to rat out their networks.

2 - Capture them but don't bother with any review of their status or require any evidence. If you have any suspicion just lock them up indefinitely.

Dang, boy, you haven't been paying attention!

The administration already tried this. This is what the fuss is all about, not criminal trials, but status review.

The SCOTUS says they MUST have status review. That was at least two years ago.

And then, when the administration tried to use "kangaroo courts" for status review, the SCOTUS said no, and sent them back to the drawing board.

And that's where we are today, still monkeying around with setting up procedures for status review.
