Gitmo doesn't equal torture.

You can have people at Gitmo and not torture them, you can torture people elsewhere. They are two separate issues, that too often get tossed together as one.

I don't know what the terms of surrender for our military involve, but it doesn't seem like the people we capture have surrendered. It seems more like they may still have a finger on some deadly influence when they are apprehended, and remain active agents while incarcerated.

In at least some, and perhaps many cases I think your correct.

I think we need to clarify what is a surrender and what or who remains and active agent of the enemy, followed by extensive policy and procedure regarding categorical classifications. Could you please ask them to work on that for me. Thanks in advance.

I know that they don't fit the classical POW definition, but the way POWs are supposed to be treated and supposed to act could be useful in this clarification. POWs have in a sense surrendered, but they are still supposed to be agents of their army/government. American POWs are supposed to escape if they get a chance, and would be expected to thwart enemy efforts if they get the chance. They are not supposed to accept parole (promise to not fight anymore in exchange for release).

So I guess you can't really say that some Al Qaida op at gitmo hasn't surrendered just because he considers himself affiliated with Al Qaida and an enemy of the US. OTOH surrendered in this context doesn't mean "has ceased all resistance".
