That's what SCOTUS said when they decided Hamdan, that it should go to Congress to get clarification. And that's what Bush is trying to do now - get clarification. Unfortunately, the same gang who filibustered Bush's judicial picks are now against this. Curious that the same Republicans who supported judicial filibusters also support civil rights for jihadis.
