Again - Where does it say that in the constitution? It doesn't. Its understood in the way duties are assigned each division of gov't. If it was understood that presidents were expected to determine constitutionality, then they would need to have educational backgrounds similar to judges. To my knowledge, none of the last six presidents had a law degree.
